Eviction
In the majority of cases, the Order Confirming, which includes an Order for Possession, is placed with the sheriff, and an eviction date is scheduled in 30 to 60 days. The sheriff often refuses to evict the parties who are not named in the foreclosure action and, accordingly, it is necessary to file a separate forcible entry and detainer action. The Order Confirming and for possession is placed with the sheriff for service on the occupants. After service and posting, the sheriff will provide an eviction date. In most counties the lender must provide movers and securing personnel at the time of eviction.
